SSA-44: Check If Your IRMAA Appeal Will Work

Form SSA-44 asks Social Security to set IRMAA from a newer year's income after a life-changing event such as retiring, a divorce or a spouse's death. Dropping even from the first tier saves $81.20 a month in Part B surcharge per person in 2026, plus the Part D add-on. Pick your event and incomes to see if filing is worth it.

Show the math

SSA normally sets IRMAA from your tax return two years back. Form SSA-44 lets it use a more recent year’s income when one of eight life-changing events reduced it. You can file as soon as the event happens; SSA adjusts the premium going forward and refunds any months overpaid in that year.

IRMAA Appeal Form: The Life-Changing Events That Count

Only eight events let Social Security use newer income. If yours isn't on the list, Form SSA-44 won't work, however much your income fell. (SSA POMS: life-changing events)

  1. Marriage
  2. Divorce or annulment
  3. Death of your spouse
  4. Work stoppage (you or your spouse stopped working)
  5. Work reduction (fewer hours or lower pay)
  6. Loss of income-producing property you didn't cause (disaster, theft, fraud)
  7. Loss or reduction of an employer pension
  8. An employer settlement because of closure, bankruptcy or reorganization

A big one-time capital gain, a Roth conversion or selling a house is not a life-changing event.

Form SSA-44: A Field-by-Field Guide With the Evidence

The form has five steps, and it can be filed by mail, at an office or by phone with a Social Security representative. Attach evidence for both the event and the new income. (SSA: Form SSA-44)

  • Step 1 — Event: tick the event and its date.
  • Step 2 — Reductions that already occurred: tax year, AGI, tax-exempt interest, MAGI.
  • Step 3 — Reductions you expect next year: an estimate if income will fall further.
  • Step 4 — Documentation: e.g. an employer letter for retirement, a death certificate, a divorce decree, plus a tax return or signed estimate.
  • Step 5 — Signature.

What dropping to the standard premium is worth per person, per month, in 2026 (CMS 2026 premiums):

Your tier now Part B surcharge Part D surcharge
Tier 1 $81.20 $14.50
Tier 2 $202.90 $37.50
Tier 3 $324.60 $60.40

IRMAA Appeal: When to Ask for Reconsideration Instead

If Social Security used the wrong tax return, or you filed an amended return, the fix is a reconsideration (Form SSA-561), not an SSA-44. The same applies if you think the tier was calculated wrongly. Both requests are free (SSA POMS: IRMAA tables).

Our take: file as soon as the event happens

Retirees often wait a year for the tax return and pay a year of surcharges they didn't owe. Use an estimate now. See your current tier on the IRMAA calculator and where 2026 income lands on the 2028 IRMAA brackets. Widowed? The qualifying surviving spouse calculator covers the tax side. Not a qualifying event? Frequently asked questions

How long does an SSA-44 take?

Often a few weeks to a couple of months. If it's approved, Social Security adjusts your premium going forward and refunds any months you overpaid in that year.

Can I file before I retire?

File once the event has happened — for retirement, after your last day of work. You can then estimate your lower income for the current year instead of waiting for a tax return.

Do both spouses need to file?

Each person on Medicare pays IRMAA separately, so each spouse files their own SSA-44, using the same household event and income.

What if my income goes back up?

SSA-44 only covers the year you estimated. If your actual income comes in higher, Social Security can adjust your premiums and ask you to repay the difference.
